Website:

The Campaign is independently administered by Fuentes Marketing & Design.

2. CAMPAIGN TYPE — NOT A RANDOM DRAWING

The Miami Website Makeover is an application-based, discretionary selection campaign.

It is NOT a random drawing, raffle, lottery, or sweepstakes.

No applicant will be selected by chance.

Fuentes Marketing & Design will review eligible applications and select the business that, in FMD's judgment, offers the strongest overall fit for the goals of the Miami Website Makeover.

NO PURCHASE IS NECESSARY TO APPLY OR BE SELECTED.

Purchasing services from Fuentes Marketing & Design will not improve an applicant's likelihood of being selected.

3. ELIGIBILITY

To be eligible, an applicant must satisfy all of the following requirements:

  • The applicant must be at least 18 years old at the time of application.
  • The applicant must be the business owner or otherwise authorized to make decisions regarding the business and its website.
  • The business must currently have a live, publicly accessible website.
  • The business must be located in, operate in, or primarily serve customers within Miami-Dade County, Florida.
  • The business must be legitimately operating and offer lawful products or services.
  • The applicant must provide accurate and reasonably current information.
  • The business must be willing and able to participate in the makeover process if selected.
  • The business must agree to the applicable Campaign requirements and Selected Business obligations.

Businesses without an existing live website are not eligible.

A traditional storefront or commercial office is not required. Eligible businesses may include brick-and-mortar businesses, service-area businesses, home-based businesses, mobile businesses, and locally based online businesses that otherwise meet the requirements.

Fuentes Marketing & Design reserves the right to verify eligibility before or after making a preliminary selection.

4. GEOGRAPHIC ELIGIBILITY

The Campaign is intentionally focused on Miami-Dade County, Florida.

An eligible business must be:

  • Located in Miami-Dade County;
  • Operating within Miami-Dade County; or
  • Primarily serving customers within Miami-Dade County.

A business located outside Miami-Dade County may only be considered if Fuentes Marketing & Design determines that Miami-Dade County is clearly one of the business's primary operating or customer markets.

Final geographic eligibility determinations are made by Fuentes Marketing & Design.

6. HOW TO APPLY

Eligible businesses must complete the official Miami Website Makeover application through Fuentes Marketing & Design's Campaign page during the application period.

The application is expected to request information including:

  • Business name
  • Applicant name and role
  • Contact information
  • Website URL
  • Business location / Miami-Dade service area
  • Industry
  • Business history
  • Social media and Google Business Profile links
  • Information about the current website
  • Current branding information
  • Business story
  • Website challenges and desired improvements
  • Project readiness information
  • Campaign participation acknowledgments

An application is not complete until the required fields and confirmations are submitted.

Submitting more than one application for the same business does not increase that business's likelihood of being selected. Fuentes Marketing & Design may consolidate or disregard duplicate submissions.

7. APPLICATION ACCURACY

Applicants must provide truthful, complete, and reasonably current information.

Fuentes Marketing & Design may disqualify an application if material information is found to be:

  • False
  • Misleading
  • Fraudulent
  • Intentionally incomplete
  • Submitted without authorization

The applicant is responsible for ensuring they have authority to submit information and materials on behalf of the business.

8. SELECTION PROCESS

Selection is holistic and discretionary.

There is no required numerical scoring formula, fixed point system, percentage weighting, or automatic ranking system.

Publicly, Fuentes Marketing & Design may consider factors including:

  • The existing website
  • Transformation opportunity
  • Business story
  • Miami-Dade relevance
  • Readiness to collaborate
  • Overall potential of the makeover

Internally, Fuentes Marketing & Design may also consider legitimate strategic and practical factors such as:

  • Local awareness
  • Willingness to participate in and share Campaign content
  • Storytelling and visual content potential
  • Potential for local publicity, mentions, referrals, or backlinks
  • Potential for the Campaign to generate meaningful visibility for both the selected business and FMD

No single factor guarantees selection.

Follower count alone does not determine the selected business.

9. OPTIONAL FINALIST PROCESS

Fuentes Marketing & Design may, but is not required to, identify one or more finalists before making the final selection.

FMD may:

  • Request additional information from finalists
  • Contact finalists for clarification
  • Review websites and public business profiles in greater detail
  • Confirm project feasibility
  • Confirm willingness to participate

If finalists are publicly featured, FMD will obtain appropriate permission before identifying them as finalists.

Public voting is not required and will not determine the selected business unless Fuentes Marketing & Design expressly announces a separate voting process.

The selected business will not be required to abandon an established trademark, legally protected mark, or existing identity against its wishes.

However, the business agrees to participate reasonably in FMD's branding review, concept, and presentation process.

Fuentes Marketing & Design may reasonably modify, suspend, postpone, or cancel the Campaign if fraud, technical failures, legal requirements, severe weather, emergency conditions, platform failures, or other circumstances outside FMD's reasonable control materially impair the Campaign.

FMD will not use this provision to arbitrarily deprive an already accepted selected business of the promised makeover.

Material public changes will be communicated through the Campaign page and/or FMD's official channels.

  • Verify eligibility

Requesting or declining an audit does not affect the selection decision.

A complimentary audit does not obligate the applicant to purchase any service.

29. SOCIAL MEDIA PLATFORM DISCLAIMER

If the Campaign is promoted through Instagram, Facebook, TikTok, LinkedIn, YouTube, or another third-party platform, that platform is not a sponsor or administrator of the Miami Website Makeover unless expressly stated otherwise.

The Campaign is administered by Fuentes Marketing & Design.

Applicants release the applicable social platform from responsibility for administration of the Campaign to the extent permitted by applicable law and the platform's terms.

30. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Fuentes Marketing & Design will not be responsible for indirect, incidental, consequential, or special damages arising solely from participation in the Campaign or from circumstances outside FMD's reasonable control.

To the extent a dispute must be resolved in court and venue may lawfully be selected, the parties agree that Miami-Dade County, Florida is the appropriate venue.

32. CONFLICT BETWEEN CAMPAIGN MATERIALS

If there is a conflict between a short advertisement, social media post, promotional graphic, or summary description and these Official Rules, these Official Rules control with respect to Campaign eligibility, selection, prize scope, and participation requirements.

A separate project agreement signed by the selected business may provide additional project-specific terms, provided that it does not materially reduce the core prize publicly promised under these Official Rules.
